Terms of Service

1. Acceptance of Terms

By accessing or using the GTA Generator Repair website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Definitions and Nature of Service

GTA Generator Repair is a lead generation platform ONLY. We operate exclusively as a referral service connecting consumers with independent third-party contractors who provide generator repair, installation, and maintenance services.

CRITICAL NOTICE:

GTA Generator Repair does NOT perform, provide, or undertake any generator repair, installation, maintenance, or related contracting services. We are NOT contractors, electricians, or service providers. All actual services are performed exclusively by independent third-party contractors who are separate legal entities with no employment, agency, or partnership relationship with GTA Generator Repair.

3. Third-Party Contractor Relationship

All contractors in our network are:

  • Independent businesses operating under their own legal authority
  • Not employees, agents, representatives, or partners of GTA Generator Repair
  • Solely responsible for all aspects of their service delivery, pricing, quality, and compliance
  • Required to maintain their own insurance, licensing, and certifications
  • Fully liable for their own actions, omissions, workmanship, and business practices

You acknowledge and agree that any service agreement, warranty, payment arrangement, or dispute is exclusively between you and the independent contractor. GTA Generator Repair is not a party to any such agreement.

4. No Guarantees or Warranties

GTA Generator Repair makes NO guarantees, warranties, or representations regarding:

  • The quality, timeliness, safety, or legality of services provided by contractors
  • The qualifications, licensing, insurance, or background of any contractor
  • The accuracy of pricing, quotes, or estimates provided by contractors
  • The completion, performance, or outcome of any work performed by contractors
  • Contractor compliance with applicable laws, codes, regulations, or industry standards
  • The resolution of disputes between you and contractors
  • The availability or response time of contractors

ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

5. User Responsibility and Due Diligence

You are solely responsible for:

  • Verifying the credentials, licensing, insurance, and qualifications of any contractor before engaging their services
  • Conducting your own due diligence and background checks on contractors
  • Reviewing and negotiating service agreements, warranties, and payment terms directly with contractors
  • Obtaining necessary permits, approvals, and inspections for any work performed
  • Ensuring contractors comply with applicable building codes and safety regulations
  • Resolving any disputes, claims, or issues directly with contractors

WE STRONGLY RECOMMEND that you verify contractor insurance, obtain written contracts, and understand your rights before agreeing to any services.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

GTA Generator Repair, its owners, officers, employees, agents, and affiliates SHALL NOT BE LIABLE for any:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Personal injury, death, or property damage arising from contractor services
  • Losses, costs, or expenses resulting from contractor negligence, errors, or misconduct
  • Breach of contract, warranty claims, or workmanship disputes with contractors
  • Delay, non-performance, or abandonment of work by contractors
  • Fraud, misrepresentation, or unlawful conduct by contractors
  • Damage to your property, equipment, or generator systems
  • Business interruption, lost profits, or consequential losses
  • Contractor failure to obtain proper permits, licensing, or insurance
  • Code violations, failed inspections, or non-compliance with regulations

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if GTA Generator Repair has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless GTA Generator Repair, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of our lead generation services
  • Your engagement with or use of services provided by independent contractors
  • Any dispute, claim, or legal action between you and a contractor
  • Contractor performance, non-performance, or misconduct
  • Personal injury, death, or property damage related to contractor services
  • Your violation of these Terms of Service
  • Your violation of any applicable laws or regulations

8. Information Submission and Consent

By submitting a service request through our website, you:

  • Consent to GTA Generator Repair sharing your contact information and service request details with independent contractors for the purpose of providing quotes and services
  • Acknowledge that contractors may contact you via phone, email, or text message
  • Understand that you may receive multiple contacts from different contractors
  • Agree that any information you provide is accurate and complete to the best of your knowledge
  • Accept responsibility for any consequences arising from inaccurate or incomplete information

9. No Professional Advice

Information provided on our website is for general informational purposes only and does not constitute professional, technical, legal, or safety advice. You should not rely on website content as a substitute for professional consultation regarding generator systems, electrical work, or building codes.

Always consult with qualified professionals before making decisions about generator repair, installation, or maintenance.

10. Payment Terms

GTA Generator Repair does not collect payment for contractor services. All pricing, payment terms, payment methods, and financial arrangements are exclusively between you and the independent contractor.

We are not responsible for payment disputes, billing errors, or financial issues between you and contractors.

11. Dispute Resolution

Any disputes between you and an independent contractor must be resolved directly between the parties. GTA Generator Repair is not responsible for mediating, arbitrating, or resolving such disputes.

For disputes with GTA Generator Repair regarding our lead generation services, the parties agree to first attempt good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Ontario, Canada, in accordance with the Arbitration Act, 1991 (Ontario).

12. Modifications to Terms

GTA Generator Repair reserves the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms.

13. Termination

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion without notice or liability.

14. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Website Disclaimer, constitute the entire agreement between you and GTA Generator Repair regarding our services and supersede all prior agreements and understandings.

16. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Ontario, Canada, and you consent to the jurisdiction and venue of such courts.
